Civil status

Important

12S birth certificates are issued in Arabic. To avoid errors, anyone who is unaware of the exact spelling of the surnames and first names of the spouse, the mother and the first name of the father is asked to attach to their application for 12S, birth certificates in Arabic for the latter. Birth certificates that have exceeded their validity period and photocopies are accepted, provided they are legible. The 12S requested by mail are drawn up and transmitted for delivery to the interested parties, to the diplomatic and consular representations which cover their places of residence.

Marginal notes on the civil status certificates of nationals born in Algeria

Any change in civil status or family situation must be reported to include it in the civil status documents.

Marriage note

The notices of marriage to be entered on the civil status certificates of Algerian nationals born in Algeria and married abroad are sent directly by the diplomatic mission which transcript the marriage, to the Algerian municipalities which cover the places of birth of the persons concerned. . The Algerian civil registrar acknowledges receipt of the notice, after having carried out the transfer of the mention in the margin of the act on the register.

Persons whose birth certificate has not been updated are invited to contact the diplomatic mission, of the place of registration of the marriage in order to request that the notice of mention of the marriage be sent to the town hall of the place of birth. .

People who celebrated their marriage at a consular post and whose civil status in Algeria has not been updated are invited to check whether the notice of marriage has been sent to the town hall of the place of birth in Algeria.

Persons born and married abroad whose birth certificates were transcribed before marriage must request the transcription of the marriage certificate from the Algerian consulate with territorial jurisdiction, in order to update their civil status. With the consulate that transcribed the birth.

Persons born abroad and married in Algeria whose birth certificate has already been transcribed must update their civil status by presenting a marriage certificate or a copy of the family book issued by the Algerian town hall. Where the marriage was solemnized

Mention of divorce/Exequatur

To be enforceable by the consular services, any divorce judgment rendered by a foreign court must be endorsed by the competent court in Algeria.

To obtain the exequatur of a judgment rendered in civil matters, persons born in Algeria or abroad and divorced before a foreign court must send a request to the personal status judge of the court corresponding to the place of their birth, if they were born in Algeria or at the court of Sidi M'Hamed in Algiers, if they were born abroad.

After completion of this procedure, the court will transmit the notice of mention of divorce, as the case may be, to the town hall of the place of birth or to the diplomatic or consular representation which will update the civil status of the persons concerned. .

The following documents along with their translation into Arabic must be attached to a handwritten application:

 

● The original and a photocopy of the final judgment of divorce

● The original of the act of notification of the judgment of divorce to the opposing party
     (document generally provided by the bailiff responsible for serving the judgment)

● An attestation or certificate of non-opposition, no appeal and no appeal in cassation to
    be requested from the clerk of the foreign court that pronounced the judgment

● If the marriage was celebrated abroad, the marriage certificate transcribed at the
     territorially competent diplomatic or consular representation is mandatory.  

● A copy of an Algerian identity document

Issuance and translation of documents

On presentation of the family book and an Algerian identity document, the person in charge  for civil status can issue a family and individual attestation  as well as extracts from civil status (birth, marriage, death) established by municipalities in Algeria or by diplomatic and consular posts.
This same service can ensure the translation into French of family book and civil status documents (birth, marriage, death) drawn up in the national language.

An Algerian identity document is required.

Divorce

To be enforceable by the consular services, any divorce judgment rendered by a foreign court must be endorsed by the competent court in Algeria.

To obtain the exequatur of a judgment rendered in civil matters, one of the ex-spouses must send a request, through a lawyer in Algeria, to the Personal Status Judge of the court corresponding to the place of birth; she or he was born in Algeria or at the court of Sidi M'Hamed in Algiers, if he was born abroad.

The following documents accompanied by their translation into Arabic, must be attached to the application

●  The original of the judgment act

●  The original act of notification of the judgment,

●  The certificate of non-opposition, no appeal and no appeal in cassation,
 

A copy of a summons note to the court for the party absent from the hearings, in case of a judgment by default..

Affidavit of law

The presence of the person concerned is mandatory, he must be provided with:
 

● An Algerian identity document (Algerian identity card, Algerian passport, consular
   registration card)

● Copy of birth certificate less than 3 months old.

Certificate of concordance or individuality certificate

When a civil status document contains a spelling, transcription or other error, a certificate of concordance or individuality certificate is drawn up in the presence of the person concerned on the basis of:

● Copy of birth certificate less than 3 months old

● The Algerian identity document of the person concerned (passport, consular card, or
    Algerian national identity card)

● No stamp duty is required.

Life-protection certificate

The presence of the person concerned is compulsory. He/she must have:

● The Algerian identity document of the person concerned (passport, consular card, or
    Algerian national identity card).

● The family book or a copy of the birth certificate

● Pay stamp duty.

Birth certificate 12S

The secure birth certificate, known as 12S, is mandatory for the establishment of the biometric passport. It is established on the basis of the civil status register.

People born in Algeria, registered with a consular post can request the 12S birth certificate by submitting an online request at the following address: http://demande12s.interieur.gov.dz

Any Algerian national established abroad can request, during a stay in Algeria, the 12S from all the municipalities of the country.

The 12S are drawn up and sent to the diplomatic and consular representations for delivery to the interested parties.

Interested parties must follow the progress of the processing of requests through the "request follow-up" tab on the home page of the site on which the request was made. When the message "get closer to the consulate concerned to recover the 12S" is displayed, they have to go to the civil status service, provided with an Algerian identity document, to personally collect their 12S and those of their minor children. (Under the age of 19)

The following information is required to submit the request via the website of the Ministry of the Interior and Local Authorities:

● Name (maiden and marital names for married women).

● First name(s)

● Date and place of birth (place/town/wilaya)

● Birth certificate number indicated on the birth certificate or on the family book.

● Consular registration number

● Registration number of the father or mother for minor children (under the age of 19)

Persons born in a consular district and residing there whose birth certificates have not been transcribed must imperatively complete the transcription formalities with the civil status service on presentation of:

● Two (02) full original copies of the birth certificate (dated less than three months)

● The family book whether French or Algerian or even both

● A document attesting to the Algerian nationality (passport, national identity card or any
    other photocopy + original proof)) of the person concerned or the father or the mother
    if the transcription concerns a minor child (under the age of 19 years).

Persons born in a consular district and registered with other diplomatic and consular representations must present themselves personally at the headquarters of the consulate or send by post (by registered mail with acknowledgment of receipt), a request for establishment of the 12S accompanied by:

● Two (02) full original copies of the birth certificate (dated less than three months)

● The family book whether French or Algerian or even both

Persons registered with a consular district, born in other countries can request their 12S from the Algerian diplomatic and consular representations which cover their places of birth by presenting themselves there personally or by sending them a request for establishment of the 12S. .

In addition, the consular post may transfer the request of the person concerned to the competent diplomatic or consular post.

The documents to be provided for this purpose are:

● Two (02) full original copies of the birth certificate (dated less than three months)

● The family book whether French or Algerian or even both

 

Rectification of civil status documents transcribed with the Algerian consular services

“No civil status document received in a diplomatic or consular post may, on the grounds of errors or omissions, be rectified except by decision of the president of any court throughout the national territory. If an act transcribed in the civil status registers is rectified by a foreign judicial decision, this must receive the exequatur of any court throughout the national territory. » Article 108 of Ordinance No. 70-20 of February 19, 1970 relating to civil status, amended and supplemented by Law No. 17-03 of January 10, 2017

Furthermore, and within the framework of the generalization of judicial services provided remotely, and in order to allow our Algerian community established abroad to benefit from the same advantages as those offered to Algerian citizens residing in Algeria, the Ministry of Foreign Affairs and the National Community Abroad and the Ministry of Justice have set up a new mechanism allowing the electronic rectification of errors contained in the civil status registers held at the level of consulates or diplomatic representations, through the portal electronic services of the Department of Justice

The request is attached to the documents required for the rectification of civil status documents (birth certificate, marriage certificate or death certificate) as the case may be.

Family record book

The issuance is made in view of:

Algerian husband
 

● The Original+ copy of the marriage certificate dated less than 03 months

● Birth certificate dated less than 3 months for the husband

● Consular card
 

Algerian husband, foreign wife:
 

● The Original+ copy of the marriage certificate

● The Original+ copy husband birth certificate dated less than 3 months or copy of birth S12

● Consular card

● Copy of wife's ID
 

Foreign husband, Algerian wife:
 

● The Original+ copy of the marriage certificate

● Birth certificate of the wife dated less than 3 months

● wife's consular card

● Copy of the husband identity document

● Husband's certificate of Muslim faith
 

Duplicate Family Book:

● Declaration of loss, theft or damage

● Algerian identity document (national card or passport)

● The Original+ copy of the marriage certificate less than 3 months old

● Copies of birth certificates of the parents and children if applicable

● Pay stamp duty.

Translation of the Family Book established in Algeria in Arabic:

● Family book

● The Original+ copy of the marriage certificate less than 3 months old

Pay stamp duty.

Certificate of celibacy, non-marriage or non-remarriage

The presence of the interested party is compulsory. It must be equipped with:

 

● The copy of the birth certificate of less than three (03) months issued by the
    municipality of birth, with all the marginal mentions (none for single people if
    necessary, not crossed out and not overloaded) plus a photocopy.

● An Algerian identity document (passport, consular card, or Algerian national identity
    card) plus a photocopy

● Two witnesses registered with the consulate, with their registration cards or their
    passports or Algerian national identity cards.

● Pay stamp duty.

Important:

This document is issued under the responsibility of the witnesses who are engaged.

Certificate of Consent to Marriage

For the establishment of this document, the presence of the guardian and the girl is mandatory.

It is issued on sight:

● An Algerian identity document of the guardian (passport, consular card, Algerian
    national identity card) plus a photocopy

● The girl's identity document (passport, consular card, Algerian national identity card)
    plus a photocopy

● Birth certificate of the young girl

● Family book

● A copy of the Algerian identity document of the person who will represent the legal
   guardian for the completion of the formalities relating to the marriage

Algerian nationality certificate

This document is only issued to persons registered with the diplomatic or consular post.

Documents to provide:

● An Algerian identity document (passport, consular card, or Algerian national

   Identity card).

● Copy of the birth certificate

● Copy of the birth certificate of the father

● Copy of the birth certificate of the mother, if the father is a foreigner.

Important :

The attestation of nationality is not equivalent to the certificate of nationality, a document which is only issued by a court in Algeria.

Transcription of civil status documents

Registration of civil status documents

The transcription consists of registering with the civil status service of the diplomatic post, civil status certificates (birth, marriage and death) drawn up by foreign town halls. This is a mandatory preliminary step for obtaining Algerian documents (consular card, passports, Identity, 12 S, etc.).

Only the acts of persons, whose Algerian nationality is established, may be registred in the consular registers of civil status.

The registration is done according to the place of birth, death or marriage and not the place of residence.

 

The Birth Registration

The file consists of:

1 Fill out the registration application form
2 A birth certificate from the civil status of the country of residence original+ a copy
3 Copies of the father’s and mother’s passports
4 Family book (Livret de Famille) to add the newborn or a copy of the marriage certificate

 

Transcription of children's birth certificates following a change in the civil status of the parents or one of them.

The transcription of the birth certificates of children whose one or both parents have changed their marital status following naturalization can only be done on the basis of an order from an Algerian court.

This step is necessary to avoid the incompatibility between the civil status of the child and that of the father or the mother born (s) in Algeria and the appeal to the procedures of justice in matter in particular of establishment of documents civil status and inheritance.

Marriage Registration

Any Algerian national living abroad may have his/her marriage registered at the Algerian Embassy. A Family Book is issued after registration. To that end, applicants must provide the following supporting documents:

1 Fill out the registration application form
2 A copy of the couple passports
3 Marriage certificate issued by the court of the original country of residence origial + a copy
4 Original birth certificate (less than three months old) of the couple
5 A copy of the birth certificate and the identity of the husband or the wife if they are not of
   Algerian nationality

 

The transcription of the marriage certificate between an Algerian national and a non-Muslim is inadmissible except in the case of the husband's conversion to the Muslim religion. The transcription request file must include the conversion certificate issued by the authorized religious authority.

 

If the spouse is a national of a country practicing several faiths, provide a document attesting to his Muslim faith (birth certificate, identity or travel document on which his faith is mentioned).

Other marriage transcription

The transcription of marriage certificates celebrated by foreign chancelleries and religious marriages is done on the basis of a transcription order issued by an Algerian court.

Death Registration

In case of death of an Algerian national, the embassy must, without delay, be contacted in order to inform the family and provide assistance and advice, if necessary. The family of deceased must also seek the services of a funeral in order to gather the appropriate following documents ;

1 Proof of citizenship of the deceased
2 Packing and sealing certificate issued by the funeral services
3 Original death certificate
4 Embalmment and sanitary certificate issued by the funeral services
5
Burial authorization issued by the municipality of the deceased birth place
